Terms of Service

1. The service

LaunchPist is a subscription software product that automates marketing tasks for app builders. Features include SEO content generation, ad creative drafting, app store optimization, social and email outreach, and integration with third-party platforms you choose to connect. Specific features available depend on your active plan.

2. Eligibility and account

• You must be at least 16 years old and legally able to enter contracts.
• You are responsible for keeping your password and Google account secure.
• You are responsible for all activity under your workspace.
• One person or company per account. No sharing single seats.

3. Trial

New workspaces start on a 3-day trial. A valid payment method is required, and a $1 activation charge is taken immediately to verify the card and open full access to the features in your selected plan. If you do not cancel before the trial ends, the plan price is charged automatically and the subscription begins. Resubscribing after a cancellation does not include a further trial.

4. Subscription, billing, and renewal

• Plans are billed in advance, monthly or annually, in US dollars through Stripe.
• Subscriptions renew automatically until you cancel from the billing page.
• Prices may change. We will notify you at least 30 days in advance for existing subscriptions; new pricing applies on your next renewal.
• Applicable taxes (VAT, GST, sales tax) are charged in addition to the plan price where required by law.
• If a payment fails, we will retry and may suspend access until payment succeeds.

5. Cancellation and refunds

You can cancel any time from Dashboard → Billing. Cancellation takes effect at the end of the current paid period. We do not pro-rate unused time. Our Refund Policy sets out the 7-day AI-visibility guarantee, the conditions you need to meet for it to apply, the period in which it can be claimed, and the other cases in which we refund. It forms part of these terms.

6. Acceptable use

You agree not to:

• Use the service to publish illegal, defamatory, or hateful content.
• Send spam, phishing, malware, or unsolicited bulk messages from integrations connected through LaunchPist.
• Resell, sublicense, or expose the service as a third-party API.
• Reverse engineer, scrape, or attempt to extract the underlying models, prompts, or training data.
• Circumvent rate limits, plan quotas, or any feature gating built into the product.
• Use the product to compete directly with LaunchPist by re-creating its core features.

7. Your content

You retain ownership of all data, brand assets, app information, and text you provide ("Customer Content"). You grant LaunchPist a worldwide, non-exclusive, royalty-free license to host, process, and transmit your Customer Content solely to operate the service for you.

Drafts, articles, ad copy, and other outputs generated by LaunchPist based on your inputs are yours to use, subject to the AI provider terms we pass through (see Privacy Policy). You are responsible for reviewing AI-generated content before publishing.

8. Third-party integrations

LaunchPist connects to platforms such as App Store Connect, Google Play Console, Google Search Console, X (Twitter), LinkedIn, and Stripe. You authorize us to access these services on your behalf using the credentials and OAuth grants you provide. Third-party services are governed by their own terms; we are not responsible for outages, policy changes, or data limits imposed by them.

9. Beta features

Some features may be marked as beta or experimental. They are provided as-is, may change without notice, and may not be covered by service level commitments.

10. Service availability

We work hard to keep LaunchPist running, but we do not guarantee uninterrupted availability. Scheduled maintenance, third-party incidents, and force majeure events may cause downtime. Where possible we will announce maintenance in advance.

11. Termination

You can terminate your subscription any time from billing settings. We may suspend or terminate access immediately if you violate these terms, abuse the service, or fail to pay. On termination, we will delete or anonymize your data per the retention schedule in our Privacy Policy.

12. Disclaimer

LaunchPist is provided "as is" and "as available". Apart from the 7-day AI-visibility guarantee set out in our Refund Policy, which is the single outcome we do commit to and is limited to a refund of your payment, we do not promise specific marketing results, ranking improvements, traffic, download counts, or revenue outcomes. We disclaim all warranties to the maximum extent allowed by law, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of liability

To the maximum extent permitted by law, LaunchPist's aggregate liability for any claim arising out of or relating to the service is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data.

14. Indemnification

You agree to indemnify and hold LaunchPist harmless from claims arising out of your Customer Content, your use of the service, or your violation of these terms.

15. Changes

We may update these terms. Material changes will be communicated by email or in the dashboard at least 14 days before they take effect. Continued use after the effective date means you accept the changes.

16. Governing law

These terms are governed by the laws of the jurisdiction where LaunchPist is established. Disputes will be resolved in the courts of that jurisdiction unless mandatory consumer protection law requires otherwise.
